New Delhi: The National Human Rights Commission (NHRC) has taken cognisance of a complaint filed by Sewa Nyaya Utthan Foundation (SNU) regarding the alleged sexual assault of a 14-year-old boy at Darul Murul Taj Madrasa in Nagpur, Maharashtra, and has issued notices under Section 12 of the Protection of Human Rights Act, 1993 to senior state authorities.
The notice has been issued to the Commissioner of Police, Nagpur, the District Magistrate, Nagpur, and the Principal Secretary, Women and Child Development Department, Government of Maharashtra, directing them to inquire into the allegations and submit an Action Taken Report (ATR) to the Commission within two weeks.
SNU’s complaint alleged that a 14-year-old boy residing at the madrasa was sexually assaulted by a teacher in June, 2026. The complaint stated that although the local police registered a case under the Protection of Children from Sexual Offences (POCSO) Act, the accused had not been arrested.
SNU also raised concerns regarding the safety of approximately ten other minor children residing at the institution and sought urgent intervention to ensure their protection. The complaint requested immediate arrest of the accused, medical and psychological assistance for the victim, and appropriate measures through the local Child Welfare Committee (CWC) to safeguard the remaining children, including relocation wherever necessary.
After examining the complaint, the NHRC observed:
“The allegations made in the complaint prima facie seem to be violations of the human rights of the victim.”
The matter was placed before the Bench of Hon’ble NHRC Member Shri Priyank Kanoongo, who took cognisance under Section 12 of the Protection of Human Rights Act, 1993.
In addition to directing an inquiry, the Commission has specifically ordered the authorities to furnish:
- A Social Investigation Report;
- An Individual Care Plan in accordance with the Juvenile Justice (Care and Protection of Children) Act, 2015;
- Information on the appointment of a support person; and
- Details of any interim relief granted by the Child Welfare Committee.
The NHRC has directed that the complete Action Taken Report be submitted within two weeks for its consideration.
Sewa Nyaya Utthan Foundation welcomes the Commission’s prompt intervention and will continue to monitor the proceedings to ensure that the victim receives justice, the accused is brought to law, and all children residing at the institution are provided with adequate protection and care.
